Robert Durst should lose his right to privacy, according to federal prosecutors in New Orleans. Durst’s defense lawyers had contended that all evidence found in his New Orleans hotel room should be thrown out.

But because the real estate heir registered at the hotel under a false name and with phony IDs, anything found in his room can be used as evidence, prosecutors say, according to Fox News.

Durst faces murder charges in California for the death of his friend, Susan Berman. But for now, he’s being kept in a Louisiana prison.

Durst is awaiting a Jan. 11 trial for illegally possessing a .38-caliber revolver as a felon.

A judge will hear arguments and decide in the coming weeks.
